Umahi guidelines out compensation for naked land house owners

The Minister of Works, David Umahi, has reiterated that the Federal Authorities doesn’t compensate for naked lands, including that every one lands belong to the federal government.
He disclosed this on the inspection of the Lagos-Calabar Coastal Freeway, Part 1 at kilometre 18, Okun Ajah axis, lately.
He stated, “Go and skim the regulation; there isn’t a compensation for naked land. All land belongs to the federal government. Therefore, if you’re taking what belongs to you, you don’t pay compensation; it’s the president that directed that anyplace we see a shanty on our hall, we must always pay compensation; it’s a sort of human meekness from the president in the direction of the individuals. We broke no regulation.
“So, the place there isn’t a infrastructure on land, they’ve to jot down to Mr. President for a course on that.”
In an interview with The Punch, the Common Secretary, Nigerian Institute of Amount Surveyors, Lagos Chapter, Folusho Ogunrinde, stated land was undeniably an asset whether or not owned by people, companies, or the federal government.
He stated, “Governments recognise the worth of land as an asset and handle it as such. As an example, you can’t encroach on government-owned land for growth as a result of it’s thought-about a part of their property.
Equally, people and personal entities purchase land both by means of inheritance, buy, or funding. When such land is taken away, the argument that compensation ought to solely be for developments and never the land itself is basically flawed. It disregards the asset’s intrinsic worth and the way it was acquired.
“The 99-year lease system in Nigeria additional underscores the worth of land as an asset, as this lease is renewable. If governments require compensation for the renewal of a lease or when public use necessitates land acquisition, people and personal house owners deserve comparable recognition and compensation for his or her land when expropriated.
“The regulation, because it stands, wants pressing redress. The concept that landowners shouldn’t be compensated for his or her land is, frankly, unjust and tantamount to fraud. Land is greater than a bodily house; it’s an financial and generational asset. To disclaim compensation for it’s to undermine the ideas of fairness and justice. Therefore, there’s a want for a assessment of the Land Use Act and constitutional provisions to align with the realities of land as a vital and worthwhile asset.”
In the same vein, the Staff Lead, Arbitration, Maritime, and Actual Property Follow Group, Stren & Blan Companions, Joseph Siyaidon, posited that non-payment of compensation on naked land was unconstitutional.
He stated, “The Land Use Act is merely an present Act and never a part of the Structure. We humbly submit that the provisions of the Land Use Act, which restrict the fee of compensation for personal properties compulsorily acquired by the federal government to solely unexhausted enhancements on the land, are unconstitutional in that they violate the provisions of Sections 43 & 44 of the Structure of the Federal Republic of Nigeria (as amended), which extends the fitting of compensation to all immovable properties, naked lands included.”
Umahi disclosed that the primary section of the coastal freeway might be accomplished by Could 29, 2025.
He stated, “By Could 29 we face the commissioning, and we now have directed all of the comptrollers of works that, by the top of April, each comptroller of works in all of the states should give us a minimal of three tasks that Mr. President goes to fee.
“From Channel 0, we’re going to be commissioning the primary 20 kilometres; nevertheless, one other 10 kilometres can be prepared on the finish of the mission inside this era, however we’re not commissioning that one, it’s going to be section 2 of part 1 for commissioning. Typically, throughout the nation, we’re going to be commissioning tasks in phases.”
In the meantime, the Performing Director of Street Design, Engr. Musa Saidi, assured that the freeway building adheres to authorised specs and contains extra measures for sturdiness. Any realignment is for public curiosity, security, and financial causes,” he stated.
