Malawi’s Data Protection Authority Seeks Industry Input on Registration Fee Structure

The Malawi Communications Regulatory Authority (MACRA), acting as the nation’s designated Data Protection Authority (DPA), has initiated a crucial stakeholder consultation process regarding proposed data protection regulations, with a specific focus on the introduction of registration fees for data controllers and data processors. The consultation, held on Wednesday at the Capital Hotel in Lilongwe, convened representatives from the private sector and other key institutions. Daniel Chiwoni, MACRA’s Head of Data Protection, articulated the authority’s intent to foster a regulatory environment that safeguards personal data while simultaneously encouraging innovation and supporting economic expansion. “We intend to hear from all relevant stakeholders before we come up with the final position, as other stakeholders are proposing that we may need to revise some of the fees,” Chiwoni stated, highlighting the collaborative nature of the regulatory development process.

This initiative is particularly significant for legal professionals, compliance officers, and corporate executives who are tasked with navigating the evolving landscape of data privacy laws. The proposed regulations aim to introduce registration fees for data controllers and data processors deemed to be of significant importance. These fees are to be tiered based on an organisation’s annual turnover, with proposed charges ranging from a minimum of K50,000 to a maximum of K7 million. Colleta Kaira, Assistant Manager at United General Insurance, emphasised the importance of such consultations for the business community. “The meeting gave us a platform to understand issues of fees and see and engage with authorities to revise the fees in order to fit the business community,” she commented, underscoring the need for fees to be proportionate and manageable for companies. MACRA’s engagement strategy is designed to ensure that the proposed fees and the broader regulatory framework are fair, practical, and responsive to the needs of organisations that will be required to comply with Malawi’s data protection laws.
