NAFDAC Secures Conviction Of Trader Producing, Selling Fake Alcoholic Drinks

A 30-year-old trader, Chidera Kolins Chukwuka, has been convicted by a Federal High Court, in Lagos, for manufacturing, packaging, distributing, selling and displaying counterfeit and unwholesome alcoholic beverages for sale.

The convict, who trades with the business name “Glorious Liquor,” was arraigned before the court presided over by Justice Ambrose Lewis-Allagoa on a six-count charge in the charge marked FHC/L/279C/2026, by the National Agency for Foods and Drugs  Administration Control (NAFDAC).

The court convicted the traders following his quilt plea to the six count-charge slammed on him by the NAFDAC.

However, the court ordered him to pay the sum of N1.650 million, as a fine option to his custodian sentence, which was parts of plea bargain agreement he entered with the prosecuting agency.

In addition, Justice Lewis-Allagoa also ordered that the offending products, which include; Johnnie Walker Red Label, Flirt Vodka, Lords Gin London Dry and Gordon’s Dry Gin, be forfeited to the NAFDAC for destruction.

The convicted trader, Chukwuka, a resident of No. 2 Kolawole Street, Ajah-Badore, Lagos State, accused of committing the offences on April 14, 2026, at No. 30 Apongbon, Lagos Island, Lagos.

The prosecution accused him of being in possession of the fake and adulterated products branded as Johnnie Walker Red Label, Flirt Vodka, Lords Gin London Dry and Gordon’s Dry Gin.

NAFDAC further accused him of manufacturing the alleged counterfeit products and packaging them in a manner considered misleading as to their safety, an offence said to contravene the Food and Drugs Act.

In addition, Chukwuka was charged with manufacturing and distributing unregistered processed food products in violation of the Food, Drugs and Related Products (Registration, etc.) Act.

The final count alleged that the defendant displayed the unwholesome products for sale at the Apongbon premises, contrary to the Counterfeit and Fake Drugs and Unwholesome Processed Foods (Miscellaneous Provisions)

The offences according to the NAFDAC lawyer, Barrister Bert Simon, are contrary to Section 1(b) of the Counterfeit and Fake Drugs and Unwholesome Processed Foods (Miscellaneous Provisions) Act,  2004 and punishable under Section 3(1) (a) of the same Act.

The convict’s actions also contravened sections 1(1) and 5 of the Food, Drugs and Related Products (Registration, ETC) Act, Cap. F33, LFN,2004 and punishable under Section 6{1}(a) and 8 of the same Act. 

Parts of the charges against the convicted trader read: “That you, Chidera Kolins Chukwuka, Male, 30 Years Old, of No 2, Kolawole Street, Ajah,Badore, Lagos State, on or about the 14” day of April, 2026, at No 30, Apongbon, Lagos Island, Lagos State, within the Jurisdiction of this Honourable Court, was found in possession of unwholesome processed foods to wit: Johnnie Walker Red Label, Firt Vodka, Lords Gin London Dry and

Gordons Dry Gin and thereby committed an offence contrary to Section 1(a) of the Counterfeit and Fake Drugs and Unwholesome Processed Foods (Miscellaneous Provision) Act, Cap. C34, LFN, 2004 and punishable under Section 3(1) (a) of the same Act. 

That you, Chidera Kolins Chukwuka, Male, 30 Years Old, of No 2, Kolawole Street, Ajah, Badore, Lagos State, on of about the 14th day of April, 2026, at No 30, Apongbon, Lagos Island, Lagos State, within the Jurisdiction of this Honourable Court, did package foods in a manner that is misleading as to its safety, to wit: Johnnie Walker Red Label, flit Vodka, lords Gin Landon dry and Gordons Dry Gin and thereby committed an offence contrary to Section 5 of the Food and Drugs Act, Cap F32, LEN, 2004 and punishable under Section 17 (1) of the same Act.

“That you, Chidera Kolins Chukwuka, Male, 30 Years Old, of No 2, Kolawole Street, Ajah, Badore, Lagos State, on or about the 14th day of April, 2026, at No 30, Apongbon, Lagos Island, Lagos State, within the Jurisdiction of this Honourable Court, did display unwholesome processed foods for the purpose of sale, to wit: Johnnie Walker Red Label, Firt Vodka, Lords Gin London Dry and Gordons Dry Gin and thereby committed an offence contrary to Section 1(b) of the Counterfeit and Fake Drugs and Unwholesome Processed foods (Miscellaneous Provision) Act, Cap. C34, LFN,2004 and punishable under Section 3(1) (a) of the same Act.”
