Lucy Letby Cleared Of Fresh Charges As Families Lose Appeal

Lucy Letby, a serial killer nurse, will not face any further criminal charges after the families of six more babies failed to overturn a decision not to prosecute her.

Letby, 35, is serving 15 life sentences for killing seven newborns during a year-long reign of terror.

The nurse also attempted to kill seven others at the Countess of Chester Hospital between June 2015 and June 2016, yet her case is the focus of a high-profile miscarriage of justice campaign.

The fresh claims concern six more infant collapses at the hospital and Liverpool Women’s Hospital, where the former neonatal nurse previously worked.

In November 2024, the Crown Prosecution Service announced that more charges were being considered against the 36-year-old, who is already receiving a life sentence.

However, the CPS ruled in January that no new charges would be brought against nine children accused of attempted murder and murder, two of whom died, because the evidential test was not met.

Six families subsequently requested an official review of their children’s decisions under the Victims’ Right to Review program.

However, after a thorough review, an independent prosecutor has supported the previous decision not to charge the former nurse any further.

Malcolm McHaffie, head of the CPS’s special crime division said: “In January 2026, after reviewing a file of evidence from Cheshire Constabulary, we decided that no further criminal charges should be brought against Lucy Letby, 36, relating to deaths and non-fatal collapses of babies at the Countess of Chester Hospital and Liverpool Women’s Hospital.

Following that, the Crown Prosecution Service received requests for the rulings pertaining to six newborns to be reviewed under the Victims’ Right to Review (VRR) program.

“A prosecutor who was not involved in the first rulings has now finished a thorough review of the case that included a reexamination of significant evidence and information.

“Six attempted murder offenses involving six infants were reexamined, but the review maintained the initial decision to file no additional criminal charges.

“The families concerned have received a letter from the Crown Prosecution Service, and meetings will be arranged to address any additional inquiries.

“We continue to think of them.”

Letby is currently serving fifteen whole-life orders after two trials in 2023 and 2024.

But since she was sentenced, many experts have come to believe that her convictions were “unsafe” and that she might have been the victim of an injustice.

Letby’s legal team, led by attorney Mark McDonald, has filed an application with the Criminal Cases Review Commission (CCRC), which may result in Letby’s convictions and case being remanded to the Court of Appeal.

Former Hereford resident Letby has consistently insisted on her innocence.

In 2024, she was twice refused the opportunity to challenge her convictions.

Her new legal team produced studies from a panel of 14 international specialists in February of last year, claiming that these investigations raise questions about the jury’s guilty judgments.

The results of a public investigation headed by Lady Justice Thirlwall into how the neonatal nurse was able to carry out her crimes will be released later this year, on an unspecified date.
