Charlie Kirk murder case: Utah prosecutors to argue Tyler Robinson should stand trial

A five-day preliminary hearing in the murder of conservative activist Charlie Kirk begins Monday in Utah, where prosecutors will argue that Tyler Robinson should stand trial. The hearing will mark the first time Kirk’s widow Erika and parents appear in court alongside the defendant, reported AP.Robinson, 23, faces a charge of aggravated murder for the September 10 shooting when Kirk died at Utah Valley University, while addressing a crowd of thousands. He turned himself in after the killing and has not yet entered a plea.Prosecutors are seeking the death penalty. Under Utah law, capital punishment requires aggravating circumstances. In this case, prosecutors will argue that the shooting endangered others in the crowd. Proceedings will be livestreamed.Starting Monday, the focus will shift to whether sufficient evidence exists to send the case to trial, and whether the death penalty is justified.Paul Cassell, a University of Utah law professor and former federal judge, described the evidence disclosed so far as pointing to a strong prosecution case. He called it what appeared to be a straightforward matter of whether grounds exist to proceed to trial.The hearing will function like a condensed trial. Prosecutors plan to present:
- DNA evidence linking Robinson to the suspected murder weapon
- Testimony from investigators
- Autopsy findings
- Witness statements
- Video footage of the killing
Although prosecutors are not required to present all their evidence at this stage and may rely on hearsay testimony.At the conclusion of the hearing, state District Judge Tony Graf will decide whether the case proceeds to trial. Media and the public will be permitted to attend, after Graf rejected a defense request to limit access.This week, prosecutors need only show reasonable grounds to believe Robinson committed the killing, a lower bar than the “beyond a reasonable doubt” standard required at trial.Authorities have said DNA consistent with Robinson’s profile was recovered from several pieces of evidence: the rifle’s trigger, the fired cartridge casing, two unfired cartridges and a towel used to wrap the weapon.According to authorities, Robinson’s parents confronted him after a surveillance photo of the suspect and details about the rifle were made public. They reportedly persuaded him to meet with a family friend, a retired sheriff’s deputy, who helped arrange his surrender.Prosecutors say Robinson left a note for his roommate,, stating he had the chance to “take out Charlie Kirk” and intended to act on it. He also allegedly sent a text message referencing having had enough of Kirk’s “hatred,” adding that some hatred “can’t be negotiated out.”Robinson’s attorneys unsuccessfully tried to prevent prosecutors from using recorded statements from the roommate at this stage. The defense argued the roommate should testify in person, so Robinson could challenge the witness’s credibility. Judge Graf ruled that such challenges would come later in the process.Kirk’s assassination prompted strong reaction from Republican allies, including President Donald Trump, who announced Robinson’s arrest during a September 12 Fox News interview and said he hoped Robinson would receive the death penalty.Kirk, along with Turning Point USA, the organisation he co-founded, played a significant role in mobilising conservative youth support for Trump’s reelection.Kirk’s widow, Erika Kirk, now leads Turning Point USA. She had advocated for maintaining public access to the case after defense attorneys sought to bar cameras from the courtroom. She publicly forgave Robinson during her husband’s memorial service.
