Udoh Joseph, 31, Arraigned Over Alleged Defilement In Agege

A 31-year-old man, Udoh Joseph, was on Wednesday arraigned before a Lagos State Magistrate Court over allegations of defilement involving an 8-year-old girl in the Agege area of Lagos State.

According to court documents, the case was filed by the Commissioner of Police against the defendant. The incident was said to have occurred on the 21st day of May, 2026.

The charge sheet stated that the alleged incident took place at about 12:50pm at No. 8, Kokumo Street, Iyana Ipaja, Agege, in the Lagos State magisterial district. The address falls within the jurisdiction of the Dopemu Police Division.

Count I of the charge alleged that the defendant unlawfully committed an indecent act against the victim. The offence was listed as being punishable under Section 261 of the Criminal Laws of Lagos State of Nigeria 2015, which addresses sexual assault.

Count II alleged that on the same date, time and place, the defendant unlawfully defiled the same 8-year-old victim. This offence was listed as being punishable under Section 137 of the Criminal Laws of Lagos State of Nigeria 2015. Section 137 prescribes life imprisonment for conviction of defilement in Lagos State.

The matter was handled by the Dopemu Division of the Nigeria Police Force, Agege. The IPO listed in the document was CPL Ridwan Akindele attached to the division.

The document indicated that the case was approved by the Directorate of Public Prosecutions, DPP, Office, Ogba, Lagos State Ministry of Justice. The DPP’s advice is required before the matter can proceed to a higher court.

The Court did not take the defendant’s plea following a motion moved by the prosecutor, Inspector Lucky Ihiehie. The prosecutor asked the Court to refer the matter to the DPP for legal advice and direction on prosecution.

The presiding Magistrate, Mrs M.O. Tanimola, ordered his remand in custody custody at the Correctional Center at Kirikiri town, Lagos, pending the outcome of the DPP’s advice. The court also directed the prosecutor to duplicate the case file and forward it to the DPP for review.

The matter was adjourned for mention to await the report of the DPP’s advice. The advice will determine whether the case will be transferred to the High Court for trial or continued at the Magistrate Court.

As at the time of filing this report, the Police had not released any further statement on the matter beyond what was contained in the charge sheet and the DPP’s referral. Efforts to get additional comments from the PPRO were unsuccessful.

Section 137 and Section 261 of the Lagos State Criminal Law 2015 provide for offences relating to defilement and unlawful sexual acts involving children. Child rights advocates say the laws are aimed at protecting minors and ensuring stiffer penalties for offenders. Legal experts note that every person accused of a crime is presumed innocent until proven guilty by a court of competent jurisdiction.
